What Should You Do When Pulled Over for a DUI?

It is important to cooperate with the officer who pulled you over in order to avoid further problems. Present your driver’s license, insurance, and registration when asked. While you should strive to be polite, you do not need to make any statements or admissions regarding your alcohol consumption. Instead, respectfully invoke your right to remain silent.

Field sobriety tests are not required by law. Should the officer ask you to take them, you have the right to decline. If you are arrested, law enforcement will take you to a precinct where you must take a breathalyzer test. Unlike field sobriety tests, breathalyzer tests are mandatory. Blow into the machine, or you may face up to one year of license suspension.

The Days After Your DUI Arrest

Before leaving the precinct, you should have a citation, a copy of your breath test ticket, and a Department of Licensing hearing request form. You may be given a summons to appear in court, or this may arrive by mail a few days later. Once you are released, call us immediately for a consultation. You will need to appear in court and appear before the Department of Licensing. These are two separate institutions. Submit your Department of Licensing hearing request form within 30 days of your arrest. If you were not given this paperwork or misplaced these documents, you can print them out from the DOL website.
